Terms and Conditions
1. The Agreement
By booking a property through Shammy Homes, you enter into a short-term lodging agreement, not a residential tenancy. This agreement is governed by the laws of the Republic of Kenya.
2. Identification & Access
To comply with building security and local regulations, the primary guest must provide a valid government-issued ID or Passport prior to check-in. Management reserves the right to deny entry if the ID does not match the booking name.
3. Occupancy & Visitors
Each property has a strict maximum occupancy limit. Unregistered overnight guests are strictly prohibited. Hosting events, parties, or commercial photo/video shoots without prior written consent will result in immediate eviction without a refund and forfeiture of the security deposit.
4. Check-In, Check-Out, and Overstays
Standard check-in is from 12:00 PM EAT, and check-out is strictly by 10:00 AM EAT. Unauthorized overstays critically disrupt subsequent guest arrivals. Remaining on the property past check-out without written management approval will incur an immediate penalty. We offer a 30-minute grace period, after which a charge of 20% of the daily rate is applied per hour until the property is vacated. We reserve the right to securely pack and remove your belongings if you refuse to vacate.
5. Smoking, Pets, and Contraband
All Shammy Homes properties are strictly 100% smoke-free indoors. This includes cigarettes, vaping, and shisha/hookah. Smoking is permitted only on the balcony. Any evidence of indoor smoking will result in the client paying for a specialized deep cleaning to eliminate the smoke smell, which includes treatments for carpets, seats, curtains, and other upholstery. This is a separate deep cleaning service from the standard house cleaning. Pets are allowed, provided they are confirmed before arrival and a security deposit is paid to cover potential damages.
6. Fair Use of Utilities
While electricity and water are provided, they are subject to fair use. Leaving air conditioning, heavy appliances, or water running continuously while absent from the property is prohibited and may result in additional utility surcharges.
7. Payments & Fraud Prevention
All direct bookings are processed via Paystack (our Merchant of Record). We do not store your credit card details. We reserve the right to cancel any booking flagged as high-risk or fraudulent by our payment processor.
8. Property Condition & Damages
You agree to leave the property in the condition you found it. You are financially responsible for any breakages, missing items, or deep cleaning required due to smoking or excessive mess. These costs will be deducted from your security deposit (including any pet-related deposits). If damages exceed the deposit, you agree to be billed for the balance.
9. Liability Disclaimer
Shammy Homes and its property owners are not liable for any personal injury, illness, or loss of personal belongings that occur during your stay. Guests use amenities (including pools and gyms) entirely at their own risk.
10. Right of Entry & Eviction
Management reserves the right to enter the property for emergency maintenance. We reserve the absolute right to evict any guest violating these terms, causing a nuisance to neighbors, or engaging in illegal activities under Kenyan law, with zero refund.
